Foodpally ("we", "us", or "our") provides a platform for users to request, purchase, and receive hot meals and related food items delivered to their doorstep ("Services"). At Foodpally, transparency is a core value. We owe you ("User") a duty to explain how we collect, use, share, and protect your personal information.

Personal information means any information that identifies you or can be used to identify you. This includes your name, email address, telephone number, delivery address, and any other personal data we collect.

If required under the NDPA, we will appoint and publish the details of a Data Protection Officer (DPO).

This Privacy Policy will be reviewed periodically (at least annually) to ensure compliance with applicable data protection laws, including the Nigeria Data Protection Act (NDPA), 2023, the Nigeria Data Protection Regulation (NDPR) 2019 (as saved under the NDPA), and any directives issued by the Nigeria Data Protection Commission (NDPC).

We continually improve our communication methods and add new features to our website and applications. When our practices change, we will update this Policy and publish the revised version on our website and applications. Material changes will be notified via the app, email, or prominent notice where appropriate.

We are committed to informing you and limiting collection to essential personal information.

You accept this Policy when you click "continue", "sign up", "agree", or a similar button to register and use any of our platforms, products, and Services. You also consent to the collection and processing of your personal information (including your name, date of birth, email address, physical address, telephone number, order details, and order history) for the purpose of providing the Services.

Before you can use our platform fully, we will ask you to choose whether to allow Foodpally to access your location and under what circumstances. Location services are important for providing accurate delivery estimates, recommending nearby options, and completing deliveries. You may change these settings at any time on your device.

Once you allow access to your location, we may obtain it through IP address, GPS, and other sensors. We may also collect Wi-Fi metadata to help improve service accuracy. This information is used primarily to deliver your order efficiently and recommend relevant options near you.


11. Communication

The Foodpally platform allows you to contact us via email, in-app chat, or other channels once an order has been placed. Foodpally may record communications received through the platform for:

  • Safety, monitoring, and quality assurance
  • Fraud prevention
  • Analytical purposes (improving services, policies, and procedures)
  • Investigating and dealing with disputes and complaints

By using this functionality, you consent to Foodpally recording and using these communications as stated in this Policy.


12. Surveys

We may request that you complete a survey to help us better understand and improve our Services. If you participate, we may collect demographic information (age, marital status, ethnicity, profession, income), which could include sensitive information. By participating, you consent to our collection and use of the information you provide in accordance with this Policy.


13. Disclosures of Your Personal Information

Foodpally will not sell or rent your information to third parties. However, we may disclose your information to:

  • Any of our group companies or subsidiaries
  • Agents, vendors, kitchens, restaurants, or partners who collaborate with us to provide Services
  • Vendor/kitchen partners to facilitate order fulfilment, complaint resolution, and follow-up on reviews
  • Companies engaged to perform services on behalf of Foodpally (e.g., payment processors, delivery partners, cloud hosting, analytics, SMS/email providers)
  • Credit reference, fraud prevention, or business scoring agencies (where applicable)
  • Debt collection agencies or debt recovery organisations (where relevant)
  • Law enforcement agencies, regulatory organisations, courts, or other public authorities if required or authorised by law
  • Investors, financial advisers, or auditors (under confidentiality)
  • Any party as required to protect against fraud, defend our rights or property, or protect customer interests

Foodpally will comply with all relevant data protection obligations in relation to any such disclosures, including ensuring that third parties use your personal information only as required for the stated purpose and in a manner consistent with applicable privacy legislation.

Your privacy and information permissions and settings can be updated at any time on the Foodpally mobile application when you are logged into your account.


14. Disclaimer

Foodpally may work with independent kitchens, restaurants, or vendors whose items are listed or fulfilled through the platform. Foodpally facilitates the purchase of your order and the delivery to your provided address upon confirmation of payment (subject to our Terms of Use).

Foodpally will not be responsible for any breach in representations made by a vendor/kitchen concerning any order and does not guarantee that such representations will be fit for purpose or accurate in every case. Quality and preparation issues are handled according to our customer service and refund policies.


15. Storage and Security

We protect your information using physical, technical, and administrative security measures to reduce the risks of loss, misuse, disclosure, alteration, and unauthorised access. These include:

  • Encryption in transit (TLS/HTTPS) and at rest where appropriate
  • Access controls and least-privilege principles
  • Firewalls and data isolation technology
  • Physical access controls to data centres (where applicable)
  • Secure Sockets Layer (SSL)/TLS for all data transmissions

Personal information is stored on servers in Nigeria and/or other jurisdictions managed by related entities or authorised vendors. Where cross-border transfers occur, we ensure they comply with the NDPA and that appropriate safeguards are implemented.

We limit access to personal information to individuals within our employ, related entities, or contracted vendors who reasonably need access to provide products or services. We will never ask for your secure personal or account information by unsolicited means of communication. You are responsible for keeping your account credentials secure.

Foodpally has no control over and assumes no liability for third-party websites, their content, or their data practices. 19. Your Rights (Access and Corrections to Personal Information)

Under the NDPA, you have the right to access, correct, amend, and delete your personal information, or object to processing in certain circumstances.

You may make any of the following requests:

  1. Confirmation of the personal information we hold about you
  2. Access to the personal information we hold about you
  3. Correction or update of inaccurate or incomplete personal information
  4. Anonymisation, blocking, or erasure of personal information no longer necessary for our services or operations
  5. Data portability — receive your data in a structured, machine-readable format or have it transferred to a third party
  6. Deletion or erasure — where we relied on your consent (subject to legal/regulatory exceptions)
  7. Withdraw consent where we rely on consent to use or disclose your personal information
  8. Lodge a complaint with the Nigeria Data Protection Commission (NDPC)

We will respond as soon as possible and within the timelines required by the NDPA (generally within 30 days, extendable in complex cases).

Note: Foodpally may retain your personal information after a deletion request if:

  • There is an ongoing investigation or unresolved issue relating to your account
  • Retention is required by applicable law
  • Necessary for legitimate business interests (e.g., fraud prevention, safety, security)
  • Required by our Records Retention Policy

When personal information is no longer required, we will take reasonable steps to delete it or de-identify it from our systems.


20. Data Protection Officer (DPO)

In compliance with the Nigeria Data Protection Act (NDPA) 2023, we have appointed (or will appoint) a Data Protection Officer (DPO) responsible for overseeing our data protection strategy and implementation.

21. Governing Law

This Policy is governed by the laws of the Federal Republic of Nigeria. Where any provision of this Policy is deemed inconsistent with a law, regulation, or convention, such provision shall be subject to the overriding law, regulation, or convention.

This Policy applies to all Users of the Services provided by Foodpally, and to anyone else who contacts Foodpally or otherwise submits information to Foodpally.
